Susie King Discusses Measuring a Client’s Capacity

In a CLE organized by the Ramsey County Bar Association on April 23, Susie King gave a presentation on “How To Measure a Client’s Capacity.” She discussed different levels of capacity required for different tasks, reviewing tests or standards of capacity for wills, for a health care directive, for a POA, and for a contract. The presentation was designed to help attorneys determine whether their clients have the required capacity for the requested legal document, and what to do if the clients lack that capacity. Susie also addressed the ethical issues that arise when considering a client’s capacity to execute different documents.
