  • Will contests: We represent clients in the challenge or defense of the validity of a will—for example, where validity is contested based on claims of undue influence on the testator, claims of lack of capacity of the testator, and claims of improper execution (relating to the legal formalities required to create a valid will).
  • Asset distribution disputes: When there are disagreements among beneficiaries about how assets should be divided, our team can help mediate and provide clarity. 
  • Creditor claims: We can help guide clients through the process of disputing or negotiating claims from creditors. We help to protect the estate’s interests and ensure that valid debts are settled in accordance with the law. 
  • Trust disputes: We provide support to clients in navigating and resolving conflicts that arise concerning the interpretation, modification, or administration of trusts. 
  • Fiduciary breaches: We work with clients to pursue or defend claims related to misconduct and breaches of fiduciary duty or proper accounting, by executors, trustees, or other fiduciaries. We also have experience defending fiduciaries against allegations and leverage our legal knowledge to clear misunderstandings and demonstrate their adherence to duties. 
  • Business and asset valuation disputes: Our Estate Planning attorneys help clients navigate the complexities of business and asset valuations. When disagreements arise about the valuation of a closely held business or asset within an estate or trust, we are well-positioned to advocate for our client and to resolve disputes.
